By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

2. Use of Service

SecondScan is provided for research and exploration only. You agree not to use it for clinical decision-making, diagnoses, or any healthcare-related decisions.

3. User Responsibilities

You certify that any medical scans you upload have been fully de-identified according to HIPAA Safe Harbor standards. You are solely responsible for ensuring no protected health information (PHI) remains in your uploads.

4. Intellectual Property

All software, content, and trademarks provided by SecondScan are owned by us or our licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

5. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SECONDSCAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

6. Limitation of Liability

In no event shall SecondScan’s total liability for any claim arising out of or related to these Terms exceed the aggregate fees you have paid to us in the twelve (12) months preceding the claim. If you have not paid any fees, SecondScan’s liability shall not exceed USD 50.

7. Changes to Terms

We may revise these Terms at any time. We will post the updated Terms here, and the “Effective date” at the top will be amended. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

8. Governing Law

These Terms and any disputes arising out of them shall be governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Massachusetts.
